TERMS AND CONDITIONS
The following terms and conditions form the basis of your contract with Wilbury Tours Limited. Any reference to ‘our’ ‘us’ or ‘we’ means Wilbury Tours Limited. Any reference to ‘you’ or ‘your’ means you, the Client. Please take the time to read this document carefully.
These terms and conditions constitute the entire agreement between you and us. By booking a tour with us you are deemed to have read and agreed to these terms and conditions. Your booking will be accepted by us on this basis.
MAKING YOUR BOOKING
To make a booking you must complete our Workshop Registration Form (“registration form”). Please complete one (1) registration form for every person who will be attending the tour. Your reservation will not be confirmed until we receive your completed registration form and payment of your deposit, as below. We note all fees listed are in USD.
A deposit of $950.00 USD is required to confirm your booking. Deposits should only be paid after receiving confirmation from us of the tour’s availability. Once you have received confirmation from us, your deposit can be paid via Paypal or by direct debit.
The payment of the tour balance is due four (4) months prior to the start of the tour and may be paid via Paypal or direct debit. We reserve all rights to cancel your reservation without issuing a refund of any deposit received if payment of the balance is not received by us by the due date specified in your “Welcome Letter”.
All deposits and balance monies paid are non-refundable unless there is a waiting list for the tour for which a guest is able to fill your spot. There are no refunds or price adjustments given for a late arrival or an early departure. If we must cancel a tour, then all monies received by us from you will be fully refunded. We are not responsible for any expenses that are incurred by you in preparation for the tour, including but not limited to non-refundable or non-transferable airline tickets, visa’s, travel delays, flight cancellations, costs associated with health issues, or any other unrecoverable travel costs.
We strongly advise you to review your personal insurance and to obtain Travel Insurance prior to traveling to cover any unexpected events that may result in loss of property, or that may prevent you from joining the tour, or cause you to leave the tour early.
You are responsible for the acquisition of passports and appropriate visas, where necessary. We recommend that such documentation is finalised at least six (6) weeks prior to the date of departure.
HEALTH AND FITNESS
Payment of the deposit by you to us acts as a warranty that you are reasonably healthy and/or fit to participate in the tour. You indemnify us from all actions, claims and demands arising out of any health or fitness related issues.
We reserve the right to remove you from a tour and retain any monies paid by you if your behaviour interferes with the tour or any other client(s) enjoyment of the tour experience in any way.
NEW ZEALAND LAW
The parties agree that these terms and conditions and the contract between us is governed in all respects by the laws of New Zealand. New Zealand law will apply to your contract and to any dispute, claim or other matter of any description which arises between us. Any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between you and us must be dealt with under the NZ Arbitration Act 1996.
We do not accept liability where the performance of our contractual obligations is prevented or affected by reason of circumstances amounting to “force majeure”. In these terms and conditions, ‘force majeure’ means any event which we or the supplier of the service(s) could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
When you book a tour with us it will be necessary for us to hold certain personal information about you in order to contact you about the tour, provide promotional material to you, and to secure bookings for goods and services to be provided to you under the tour contract. Your personal information may be supplied to third parties if required for us to achieve the above purposes. We reserve the right to use any photographs or videos taken during tours for promotional purposes. This may include, but is not limited to use online, in printed material or at public events. You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
